‘Exceptional circumstance’ may require extra Thorough Examinations to keep compliant.
CFTS — the national standard for Thorough Examinations — has issued a warning that workplace equipment may require extra inspections due to ‘exceptional circumstances’ to fully comply with LOLER 98.
In order to comply with HSE guidelines, inspections need to be completed on time and in line with legal requirements. However, what some managers miss is the need for extra inspections in ‘exceptional circumstances’
CFTS Director Rob Fisher says: “Fortunately, a lot of employers and operators are now aware that their lifting equipment requires regular inspections once or twice a year. However, there are situations where an extra Thorough Examination might be needed. We often see these get missed as people assume that their previous inspection covers it.”
When will you need an extra Thorough Examination?
As per regulations, an ‘exceptional circumstance’ is an event or action that could compromise equipment safety.
This includes an incident where equipment integrity has been affected. For example, following overloading, impact, or damage to equipment, an extra Thorough Examination is required to ensure equipment is up to scratch and legally compliant.
In addition, if equipment has had modifications made or has been out of use for a sustained period, it’s likely that a new inspection is required, outside of your usual schedule.
Rob Fisher adds: “Ultimately, it is the responsibility of the duty holder to ensure equipment is safe to use on site and has had its required inspections. If an incident occurs with equipment that hasn’t had an inspection, then it leaves businesses exposed to risk and prosecution. With the HSE’s 94% conviction rate, it’s really not worth the risk.”

In the last decade alone, the average fine has more than doubled with figures routinely hitting £1 million or more.
Rob Fisher continues: “My advice to anyone whose equipment has had damage or modifications is to talk to your local provider. They will be able to discuss the exceptional circumstances that require an extra inspection and keep you covered”.
